General Terms and Conditions of Atelier Frenchie (KvK 80888062) filed on November 5, 2020, with the Chamber of Commerce.
Article 1 | General
1.1 The general terms and conditions of Atelier Frenchie apply to all products, orders, offers, deliveries, and agreements. These, together with the references they contain, apply to every agreement we make with you. Please read the general terms and conditions carefully before placing an order. If you have any questions, do not hesitate to contact us via info@atelierfrenchie.nl.
Article 2 | Agreement and Order
2.1 The agreement between Atelier Frenchie and you is binding at the moment you place an order. Atelier Frenchie processes the order after payment is received. Until that moment, Atelier Frenchie remains the sole owner of the products.
2.2 Once your order has been processed, you will receive a confirmation email with the details of your order. The invoice will be sent by email.
2.3 Images and specifications are indicative. Some products are handmade and may therefore vary slightly. This is also stated in the product description of the respective products. If a product does not meet your expectations, you may return it (see Article 6), but this cannot be a reason to file a claim.
Article 3 | Payments
3.1 Atelier Frenchie currently offers various payment methods, namely iDeal, PayPal, credit card, Apple Pay, and Bancontact.
3.2 If Atelier Frenchie mistakenly listed an incorrect price on the website, and this is a clear error, Atelier Frenchie has the right to correct it, even if you have already ordered the item. The order can then be canceled, and the amount will be refunded to the account used for payment.
3.3 All product prices on www.atelierfrenchie.nl include VAT but exclude shipping costs.
3.4 Discount codes are valid on all items except for sale items, promotions, or as otherwise stated.
Article 4 | Delivery
4.1 Atelier Frenchie delivers all orders within the Netherlands via PostNL.
4.2 If you accidentally provided an incorrect delivery address, chose the wrong delivery option, or were not at home when PostNL attempted delivery—and therefore additional costs apply—Atelier Frenchie will charge you these costs.
4.3 Atelier Frenchie will ship your order as soon as possible after receiving your payment. Atelier Frenchie aims to deliver your order within the expected delivery time of three working days. If this is not possible for any reason, we will contact you.
4.4 Until the moment of delivery, Atelier Frenchie is responsible for the order. After delivery, responsibility is transferred to you.
4.5 Please note that the delivery times mentioned in 4.3 are the expected delivery times. If a product is not delivered within the expected period, it is not possible to file a claim. However, Atelier Frenchie will always do everything possible to ensure that you receive your order on time.
4.6 Local orders are delivered by Atelier Frenchie within 36 hours unless otherwise stated.
4.7 Atelier Frenchie will ship all orders outside The Netherlands with PostNL. For shipping costs, visit our shipping and return page.
Article 5 | Inspection Period
5.1 Atelier Frenchie strives to make all customers happy with their purchase. However, we advise you to check your purchases for quality and quantity within fourteen working days. If something is not right, please contact us via info@atelierfrenchie.nl.
Article 6 | Returns
6.1 Of course, we hope you are satisfied with your purchase. However, if you wish to return a purchase, you have a 14-day cooling-off period from the date you received the order in which you can return the purchase. We do not offer exchanges.
6.2 Sale items cannot be returned.
6.3 The costs and responsibility for the return shipment are your responsibility.
6.4 If goods are used, damaged, or incomplete, we have the right to refuse the returned items. This also applies to returns that are not sent back within the period specified in Article 6.1.
6.5 Refunds will be made within 14 days after receipt and inspection of the return.
6.6 Refunds will be made via the original payment method. Atelier Frenchie can only refund to the account used for the original payment.
Article 7 | Warranty
7.1 After the inspection period of fourteen days (Article 5), Atelier Frenchie provides a one-month warranty on the quality of a product. If you are not satisfied with the quality of a product, please contact us via info@atelierfrenchie.nl.
7.2 Atelier Frenchie will provide a suitable solution and will decide which of the following options is chosen:
- Repair.
- Replacement.
- Refund.
7.3 In the case of a refund, the refund (including shipping costs) will be made within 14 days after receipt and inspection of the return.
7.4 If we repair or replace the item, this may take up to 14 days unless otherwise communicated.
7.5 The warranty expires after 14 days. We do not offer a warranty if the cause of the damage cannot be traced or if the product has been used for a different purpose.
Article 8 | Copyright
8.1 All rights (such as copyrights, trademarks, and logos) on our texts, photos, images, and other materials are our property (or are managed by us with the permission of the rights holder). Your use must not infringe upon these rights. Without the written permission of Atelier Frenchie, photos, images, and texts may not be reproduced or publicly used.
Article 9 | Dispute Resolution
9.1 These general terms and conditions and the agreements we make with you are governed by Dutch law. In the event of a dispute, the court in Amsterdam has jurisdiction.
9.2 As a consumer, you can use the ODR platform (Online Dispute Resolution). This platform offers a simple, efficient, fast, and inexpensive out-of-court solution for disputes arising from online transactions. For more information, see: http://ec.europa.eu/odr.
